Terms of Service

 

These terms are a legal agreement between you and EducAitor Ltd, a company registered in England and Wales (company number 17163883) with its registered office at Rutters Garth, Esh, Durham, DH7 9QS (“EducAitor”, “we”, “us”), covering your use of the EducAitor mobile apps, website and related services (the “Service”). By creating an account or using the Service you agree to these terms.

If you are using EducAitor through your school or organisation, a separate agreement between EducAitor and that organisation may also apply; where the two conflict, the organisation’s agreement takes precedence for its users.

EducAitor is a professional development tool for education professionals. It lets you record your own lessons, receive an automatic transcript and AI-generated feedback against a teaching framework, track your development over time, and — if you choose — share reports with leaders in your organisation.

EducAitor is a development aid, not an assessment system. AI-generated feedback is intended to support reflection and growth. It is not a substitute for professional judgement, formal observation, appraisal or capability processes, and should not be used as the sole basis for any employment decision.

– You must be at least 18 years old and an education professional (or otherwise authorised by your organisation) to use the Service.

– Keep your login credentials confidential. You are responsible for activity on your account.

– Provide accurate account information and keep it up to date.

– Organisation invite codes are for the people they were issued to; do not share them outside your organisation.

You are responsible for making sure any recording you make complies with the law and with your organisation’s policies. In particular:

– only record lessons or sessions you are professionally involved in and are permitted to record;

– follow your organisation’s requirements about notifying staff, pupils or parents, where applicable;

– do not use the Service to covertly record colleagues or other people.

EducAitor deletes lesson audio automatically after processing, as described in our Privacy Policy.

You agree not to:

– use the Service for any unlawful purpose, or to harass, discriminate against or harm anyone;

– upload content you do not have the right to record or share;

– attempt to access other users’ data, probe or disrupt the Service, or bypass security controls;

– reverse engineer, scrape, or resell the Service;

– use the Service to build a competing product;

– misuse AI feedback as a disciplinary or ranking instrument contrary to section 1.

We may suspend or terminate accounts that breach these terms.

– You (or your organisation) own your content — recordings, transcripts, reports, check-ins and comments.

– You grant EducAitor a limited licence to host and process that content solely to provide the Service to you (for example, transcribing your recording and generating your report). We do not use your lesson content for advertising, and our AI providers are contractually barred from training their models on it.

– You can delete individual sessions, or your whole account, at any time in the app.

Reports are private to you unless you actively share them. When you share a report with a leader, you allow that person to view it and comment on it, and the underlying scores to be included in your organisation’s aggregate analytics. You can manage sharing per report.

Feedback, scores and coaching responses are generated by artificial intelligence based on the transcript of your lesson. AI output can contain mistakes, omissions or imperfect judgements — for example where audio quality is poor or discussion is highly context-dependent. Always apply your own professional judgement. We continually work to improve feedback quality, but we do not warrant that any specific output is accurate or complete.

We aim to keep the Service available and reliable, but it is provided “as is” and we do not guarantee uninterrupted availability. We may modify, add or remove features as the Service evolves, and will give reasonable notice of any change that materially reduces core functionality for paying organisations.

Access may be provided under a free pilot, a paid subscription, or an agreement with your organisation. Pilot access is provided for evaluation and may be time-limited. Fees, terms and renewal arrangements for paid plans are set out in the applicable order or agreement with your organisation.

The Service — including its software, design, frameworks authored by EducAitor, and branding — is owned by EducAitor or its licensors. Frameworks created by your organisation remain your organisation’s. Nothing in these terms transfers ownership of either side’s intellectual property.

You can stop using the Service and delete your account at any time in Settings. We may suspend or terminate access for material breach of these terms, and will where reasonable give you notice and a chance to remedy the breach first. On account deletion, your data is removed as described in the Privacy Policy.

Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law. Subject to that:

– we are not liable for indirect or consequential losses, loss of profits, or loss of data caused by events outside our reasonable control;

– our total aggregate liability arising from the Service is limited to the amounts paid for the Service in the 12 months before the claim arose (or £100 if you use a free account);

– we are not liable for decisions made by you or your organisation in reliance on AI-generated feedback, which is provided as a development aid only (section 1).

– These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory local law gives you additional protections.

– If any part of these terms is found unenforceable, the rest remains in effect.

– We may update these terms from time to time; we will post the updated version with a new date and notify you in the app of significant changes. Continued use after changes take effect constitutes acceptance.
