Terms of service

The terms that govern your use of the EducAitor app, the web app and this website.

Last updated

These terms govern your use of EducAitor®: the EducAitor® app, the web app at app.educaitor.ai and this website (together, "the Service"). By creating an account or using the Service you agree to them. If you use EducAitor through your school, trust or other organisation, your organisation's agreement with us also applies, and takes priority over these terms if they conflict.

1. About us

The Service is provided by EducAitor Ltd, company number 17163883, registered in England and Wales, Rutters Garth, Esh, Durham, DH7 9QS. Contact: support@educaitor.ai.

2. What EducAitor is

EducAitor is a professional development tool for education professionals. You record lessons and receive AI-generated feedback, choose focuses, reflect, log professional development, and, if you are a leader, see anonymous team trends and who in your team is recording. EducAitor supports reflection and growth. It is not a formal assessment, appraisal, capability or performance-management tool, and it should not be used as one.

3. Who can use it

You must be at least 18 and use the Service in a professional education role. You must give accurate account information and keep your sign-in details confidential. You are responsible for activity on your account; tell us straight away if you think it has been misused.

4. Accounts

  • Organisation accounts are set up by EducAitor for a school, trust or other organisation. The organisation's owners and leaders manage its settings, framework, members and seats.
  • Personal accounts are for individuals using EducAitor on their own.
  • If you leave an organisation, your organisation may remove you. If you later join an organisation from a personal account, your lessons and reports come with you and stay private to you.

5. Recording lessons

You are responsible for making sure any recording you make is lawful and follows your organisation's policies, including telling pupils, parents and colleagues where required. Only record your own lessons or sessions you are entitled to record. Do not record private conversations. We delete lesson audio automatically once your report has been written.

6. AI feedback

Feedback is generated by AI and may sometimes be inaccurate or incomplete. Use it alongside your own professional judgement and that of colleagues. Decisions about people (for example about employment, pay or capability) must not be based on EducAitor feedback alone. If a report looks wrong, use "Something not right?" in the report.

7. Acceptable use

You must not:

  • use the Service for anything unlawful, or to harass, discriminate against, bully or harm anyone;
  • enter pupils' names, registers or other pupil records, or other people's personal information beyond what the Service needs;
  • try to access another person's account or data, or to identify individuals from anonymous team figures;
  • post anything in Community that is offensive, defamatory, confidential or infringes others' rights;
  • copy, resell, reverse engineer or disrupt the Service, or use it to build a competing product;
  • upload malware or overload our systems.

We may remove content or suspend accounts that break these rules.

8. Your content

You (or your organisation) own your content: recordings, transcripts, reports, reflections and posts. You give us a limited licence to host and process it only to provide and secure the Service, and to create anonymous, aggregated information that cannot identify you or your organisation, which we may use to improve EducAitor. Our Privacy Policy explains how we handle personal information.

9. Our intellectual property

EducAitor® is a registered trade mark of EducAitor Ltd. The Service, its software, design and content (other than your content) belong to us or our licensors. You may use them only as part of the Service.

10. Plans and payment

  • Organisation accounts: fees, seats and payment terms are set out in your organisation's order or agreement.
  • Personal accounts: personal accounts are currently set up by EducAitor and invoiced as agreed with you.
  • Payments made through this website are processed by our payment provider; we do not see or store card details.
  • We may change prices with at least 30 days' notice; changes apply from your next billing period.

11. Availability and changes

We aim to keep the Service available and secure, but we cannot guarantee it will always be uninterrupted or error-free. We may improve, change or withdraw features; if a change significantly reduces what you have paid for, we will tell you in advance.

12. Ending your use

You can stop using the Service and delete your account at any time (see Delete my account). Organisations can remove members. We may suspend or close accounts that break these terms, or if required by law. When an account is deleted, we delete its data as described in our Privacy Policy.

13. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law. Otherwise:

  • we are not liable for loss of profit, business, data or goodwill, or for indirect or consequential loss;
  • we are not liable for decisions made by you or your organisation in reliance on AI-generated feedback;
  • our total liability in any 12 months is limited to the amount you (or your organisation, for your account) paid us in that period, or £100 if nothing was paid.

If you use the Service as a consumer, you also have legal rights that these terms do not affect.

14. Changes to these terms

We may update these terms. We will tell you about significant changes in the app or by email before they take effect. If you keep using the Service after that, the new terms apply.

15. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you may also bring proceedings in your local courts.
